Welcome to Lionote!

To use Lionote, the user (hereinafter referred to as "You") must read and comply with the Lionote Terms of Service (hereinafter referred to as the "Agreement") and the Lionote Privacy Policy. Please read all terms carefully and ensure you fully understand them before accepting.

Unless you have read and accepted all terms of this Agreement, you are not authorized to download, install, or use this software and related services. Your acts of downloading, installing, using, obtaining a Lionote account, logging in, etc., shall be deemed that you have read and agreed to be bound by the aforementioned agreements.

If you are under the18, please read this Agreement in the presence of your legal guardian (hereinafter referred to as "Guardian") and pay special attention to the terms regarding use by minors.

1. Scope of the Agreement

1.1 This Agreement is a contract between you and Lionote regarding your use of Lionote's services.

1.2 Lionote's products and services refer to the products and services provided by Lionote to you, including but not limited to the recording, editing, modification, and storage of text, images, audio, video, etc., with the specific services subject to what Lionote actually provides (hereinafter referred to as the "Services").

1.3 This Agreement also includes the Lionote Privacy Policy. Furthermore, when you use a specific Lionote service, there may be separate agreements and related business rules (collectively referred to as "Separate Agreements"). Once published, the above content becomes an integral part of this Agreement, and you shall comply with them accordingly.

2. Account Registration and Use

2.1 User Eligibility You confirm that before you begin the registration process to use the Lionote Services, you possess the civil capacity commensurate with your actions according to the laws of the People's Republic of China. If you lack the aforementioned civil capacity commensurate with your actions, you and your guardian shall bear the consequences arising therefrom according to the law. Additionally, you must ensure that you are not subject to trade restrictions, sanctions, or other legal or regulatory restrictions implemented by any country, international organization, or region.

2.2 Account Description

2.2.1 Account Acquisition After you read and agree to this Agreement and complete all registration steps as prompted, you can obtain a Lionote account. If Lionote's system determines that you have engaged in improper registration or use of an account, we may take measures such as suspending the account.

2.2.2 Account Use You have the right to use the mobile phone number or other identifier you set or confirmed ("Account Name") and the password you set (collectively, the "Account") to log in to Lionote. As your account is linked to your personal information, your account is for your use only. You enjoy the right to use your account. Lionote owns the account. In using it, you shall not transfer this right of use in any way without authorization, nor shall you misappropriate another user's account in any form. Actions performed through the account will be deemed actions of the registered user of the account. If the use of your account may endanger your account security and/or the information security of other users, we may take corresponding security measures.

2.2.3 Account Security Your account is set by and shall be kept confidential by you. We will never actively ask you for your account password. We strongly recommend that you keep your account secure. Lionote shall not be liable for losses and consequences resulting from your active disclosure of your account or you being attacked, defrauded, etc., by others. You should seek compensation from the infringer through judicial, administrative, or other relief channels. Furthermore, you are responsible for all consequences of activities under your account.

2.2.4 Routine Maintenance If you discover any unauthorized use of your account to log in to Lionote or any other circumstances that may lead to the theft or loss of your account, it is recommended that you notify us immediately and authorize us to take appropriate measures to protect your account information. Please understand that any action we take in response to your request requires reasonable time, and actions taken at your request may not avoid or prevent the formation or expansion of damages.

3. Provision, Protection, Guarantee, and Authorization of User Information

3.1 Provision of User Information When using Lionote Services, you need to provide your information (including contact number, etc.) accurately and completely as prompted on the pages. You understand and agree that you should provide true and valid information. To provide you with better services, you need to update your information promptly. In cases where laws explicitly require the platform service provider to verify user information, we will conduct checks and verification according to law, and you need to cooperate by providing the latest, true, complete, and valid information. If you fail to provide information promptly, the information you provide is obviously untrue, or administrative or judicial authorities verify that the information you provide is invalid, you shall bear the resulting losses and consequences to yourself, others, etc. We may issue an inquiry notice to you and require you to undergo re-authentication, until suspending or terminating providing part or all of the Lionote software services to you.

3.2 Protection of User Information

3.2.1 Protecting user information is a fundamental principle for us. Lionote will take reasonable measures to protect user information. Except as required by laws and regulations, Lionote will not disclose user information to third parties without the user's permission. Lionote uses professional encryption storage and transmission methods for related information to ensure the security of user information.

3.2.2 Lionote will establish sound internal management systems, strictly adhere to standardized operational procedures and security technologies to protect users' personal information from unauthorized access, use, or disclosure, and will regularly test the effectiveness of the aforementioned security measures.

3.2.3 Lionote will implement classified and hierarchical management of the collected user information and adopt corresponding security technical measures such as encryption and de-identification for protection.

3.2.4 Lionote will reasonably determine the operational permissions for processing personal information within the company, regularly conduct security education and training for employees, and ensure that all personnel with access to personal information are bound by confidentiality obligations.

3.2.5 Lionote attaches great importance to the protection of minors' personal information. If a user is a minor under the age of 18, they should obtain the consent of their parent or legal guardian before using the software services.

3.2.6 Report any instances of unauthorized access or use of personal information to Lionote promptly.

3.2.7 For more information regarding the relevant policies on personal information and privacy protection, please see the Lionote Privacy Policy. Matters related to information protection not explicitly stipulated in this Agreement shall be governed by the Lionote Privacy Policy.

3.3 Guarantee and Authorization of User Information

3.3.1 Guarantee of User Information To maintain a healthy internet environment and protect the corresponding rights of rights holders, you declare and guarantee that you have corresponding, legal rights to the information you register. Otherwise, we may according to law or this Agreement take measures such as deletion or blocking of your information to mitigate the impact caused by improper conduct. You shall ensure that the information you publish does not contain the following content: (1) Violating the basic principles established by the national constitution and prohibitive provisions of laws and regulations; (2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity; (3) Harming national honor and interests; (4) Promoting cults, superstition, obscenity, pornography, gambling, violence, terror, or inciting crime; (5) Fraudulent, false, inaccurate, or misleading; (6) Infringing upon the intellectual property rights of others or involving trade secrets and other proprietary rights of third parties; (7) Insulting, slandering, intimidating, involving privacy of others, or otherwise infringing upon the legitimate rights and interests of others; (8) Containing viruses, Trojans, crawlers, or other malicious software or code that may destroy, tamper with, delete, affect the normal operation of the Lionote software system or obtain data and personal information of Lionote and other users without authorization; (9) Other content contrary to social public interests or public morals that is unsuitable for publication on Lionote.

3.3.2 Authorization of User Information For non-personal information such as text, pictures, videos, audio, etc., that you provide, publish, or form during the use of Lionote software services (excluding personal information), you grant us, free of charge, during the legally prescribed protection period, the right to obtain evidence and file lawsuits against third-party infringements. Please confirm that you agree to our storage, use, copying, revision, editing, publishing, display, translation, distribution of your non-personal information, or the creation of derivative works therefrom. To facilitate your use of other related services of Lionote, you authorize us to transfer the information you provide and form during the account registration and use of Lionote services to other related service providers, or to obtain from other related service providers the information you provide and form during the registration and use of their related services.

4. Rules for Using the Services

4.1 In the process of using Lionote's products or services, you shall abide by the following rules:

4.1.1 Comply with Chinese laws, regulations, administrative rules, and normative documents;

4.1.2 Abide by agreements, systems, and other documents related to Lionote software services;

4.1.3 Shall not use Lionote software services for any illegal or criminal purposes;

4.1.4 Shall not infringe upon the legal rights of any third party in any form;

4.1.5 Shall not perform any acts that may adversely affect the normal operation of the Internet.

4.2 User Breach and Handling

4.2.1 When using Lionote's products or services, if you have any of the following circumstances, it shall be deemed a breach: (1) Violating the Constitution, relevant laws and regulations, etc.; (2) Violating the terms of this Agreement, the Lionote Privacy Policy, and other relevant agreements.

4.2.2 Please confirm that you bear independent and full legal responsibility for your use of Lionote's products or services. If you breach this Agreement, relevant state organs or institutions may initiate lawsuits, impose fines, or take other sanctions against you and require us to provide assistance. You shall bear all liability for damages caused thereby including but not limited to direct economic losses, reputational losses, and indirect economic losses such as compensation paid, attorney fees, litigation costs, etc. Furthermore, we reserve the right to monitor your use and other behaviors. If you are reported or found to be in breach, to resolve issues promptly and protect the legal rights of all parties, we may independently judge and take appropriate measures including but not limited to deleting or blocking related content through technical means, disconnecting links, suspending or terminating services provided to you, etc.

4.3 Change, Interruption, Termination of Service

4.3.1 You understand and agree that based on operational strategy adjustments, we may change the service content, and may also interrupt, suspend, or terminate services.

4.3.2 If any of the following circumstances occur, we have the right to interrupt or terminate the provision of services to you: (1) According to legal regulations, you should submit true information, but the information you provide is untrue, or inconsistent with the registration information without providing reasonable proof. (2) You violate relevant laws and regulations, the Lionote Privacy Policy, or the terms of this Agreement. (3) Requirement by judicial organs or competent authorities according to legal regulations. (4) For security reasons or other necessary circumstances.

4.3.3 You are responsible for backing up data stored through the services. If your service is terminated, we have the right to permanently delete your data from the server, unless otherwise stipulated by laws and regulations. After service suspension or termination, we have no obligation to provide or return your data to you.

4.4 Information We May Send

4.4.1 Please confirm that we or third parties may send or display advertisements or other information (including commercial and non-commercial information) to you through various methods such as SMS, email, or electronic messages. The specific sending and display methods, frequency, and content of advertisements or other information are subject to the actual provision. If you do not wish to receive this information, you can follow our relevant prompts and choose to unsubscribe on your device.

4.4.2 We may send service-related announcements to you when necessary (e.g., when suspending a service for system maintenance). You may not be able to cancel these service-related, non-promotional announcements.

5. Force Majeure and Other Disclaimer Reasons

5.1 During the use of Lionote products and services, you may encounter risk factors such as force majeure, which may affect the products or services. Force majeure refers to objective events that cannot be foreseen, overcome, avoided, and have a significant impact, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, riots, and government actions. When the above situation occurs, we will strive to cooperate with relevant units at the first opportunity to deal with it promptly, but we shall be exempt from liability for losses caused to you within the scope permitted by law.

5.2 Within the scope permitted by law, we are not responsible for consequences such as service interruption or obstruction, losses, etc., caused by the following circumstances:

5.2.1 Damage caused by computer viruses, Trojans, other malicious programs, or hacker attacks.

5.2.2 Malfunctions in your or our computer software, systems, hardware, and communication lines.

5.2.3 Your improper operation or use of the Services through illegal, non-compliant, or unauthorized means.

5.2.4 Outdated program versions, aging equipment and/or compatibility issues, system instability.

5.2.5 Other circumstances beyond our control or reasonable foresight.

5.3 In the process of using Lionote services, you may encounter risks brought by network information or other users' behaviors, and may encounter acts by other users that damage legal rights (including but not limited to intellectual property rights). We do not make promises or guarantees or assume responsibility for the accuracy, authenticity, applicability, or legality of any information, nor are we responsible for damages caused by users' infringements. These risks include but are not limited to:

5.3.1 Information from others, anonymous or impersonating, containing threatening, defamatory, offensive, or illegal content.

5.3.2 Suffering from being misled, deceived, or other causes that lead or may lead to any psychological, physiological harm, or economic loss.

5.3.3 Other risks arising from network information or user behavior.

5.4 We cannot make promises or guarantees regarding content or services provided by third parties relying on Lionote. Within the scope permitted by law, we disclaim liability for direct, indirect, incidental, special, and consequential damages that may or will result from the aforementioned content or services for which no promise or guarantee is made.

5.5 The right we obtain pursuant to this Agreement to handle illegal and non-compliant content does not constitute our obligation or commitment. Please understand that due to the uncontrollable nature of user behavior, we cannot guarantee timely discovery of illegal acts or corresponding handling.

5.6 In any case, we strongly advise you not to readily believe requests for loans, passwords, or other information involving property. For operations involving property, always verify the identity of the other party first.

6. Intellectual Property Clause

6.1 All text, graphics, and commercial logos used by Lionote in this service, the copyrights or trademark rights therein, and the intellectual property rights of the content provided including but not limited to web pages, text, pictures, audio, video, charts, computer software, etc.) are owned by the provider of Lionote products and services.

6.2 When using Lionote, you shall ensure that the content you publish and upload including but not limited to text, pictures, audio, video, and the sounds, dialogues, and related works contained in the audio or video, etc. is legal and does not infringe upon the legitimate rights and interests of others.

6.3 Unless otherwise stated, the copyrights, patent rights, and other intellectual property rights upon which Lionote's services are provided are owned by the provider of Lionote products and services.

6.4 The intellectual property of the above and any other content contained in this service are protected by law. Without the written permission of Lionote, the user, or the relevant right holder, no one may use or create related derivative works in any form.

7. Application and Modification of the Agreement

7.1 Scope of Application

7.1.1 This Agreement applies to all our products and services.

7.1.2 Certain services have their own specific rules or agreements. These rules or agreements provide more specific explanations for the corresponding services. If there is any inconsistency between this Agreement and the rules or agreements of specific services, the latter shall prevail.

7.1.3 Please note that this Agreement does not apply to services provided by other companies or individuals. Your use of such third-party services is subject to their service agreements (not this Agreement), and you need to read their agreement content carefully.

7.2 Modifications

7.2.1 We will not restrict the rights you are entitled to under this Agreement without your explicit consent.

7.2.2 For major changes including but not limited to significant changes in our product and service models), we will provide more prominent notice. In such cases, if you continue to use our services, it means you agree to be bound by the revised agreement. If you do not accept the modified latest terms of the agreement, you may immediately stop using Lionote services or cancel your account.

8. Governing Law and Jurisdiction

8.1 The establishment, validity, performance, interpretation, and any disputes arising from this Agreement shall be governed by the laws of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan regions). If the law has no relevant provisions, reference shall be made to relevant commercial practices and/or industry practices.

8.2 Any disputes or controversies between you and Lionote arising from your use of Lionote products or services related to Lionote services shall first be resolved through friendly negotiation; if negotiation fails, you agree to submit the dispute or controversy to the competent people's court in the location of Hangzhou Strawberry Interactive Entertainment Technology Co., Ltd. for litigation resolution.

8.3 The headings of all clauses in this Agreement are for reading convenience only and have no actual meaning themselves. They cannot be used as a basis for interpreting the meaning of this Agreement.

8.4 If any clause of this Agreement is invalid or unenforceable for any reason, the remaining clauses shall remain in effect.

9. Miscellaneous

9.1 The final interpretation right and modification right of this Agreement belong to the provider of Lionote products and services.

9.2 Lionote has the right to change the terms of this Agreement when necessary. You can review the latest version of the agreement terms on the relevant pages of Lionote. After the terms of this Agreement are changed, if you continue to use Lionote, it shall be deemed that you have accepted the changed agreement and all its terms.
